Is the Bible a lawfully written document?

Did he inherit a Kingdom from his family estate?

A testator is a man who makes and leaves a will or testament at death.

Will you or have you already received an inheritance? Do you have a will? If not, do you need one? Analogy of preparing a will (covenant, testament, will) – use this to illustrate Biblical principles that are misunderstood. We can partake in the most precious inheritance, or we can err (Colossians 1:12).

Terminology

  • Administrator - person appointed or who petitions to administer an estate in an intestate succession. The antiquated English term of administratrix was used to refer to a female administrator but is generally no longer in standard legal usage.
  • Beneficiary - anyone receiving a gift or benefitting from a trust
  • Bequest - testamentary gift of personal property, traditionally other than money.
  • Codicil - (1) amendment to a will; (2) a will that modifies or partially revokes an existing or earlier will.
  • Decedent - the deceased (U.S. term)
  • Demonstrative Legacy - a gift of a specific sum of money with a direction that is to be paid out of a particular fund.
  • Descent - succession to real property.
  • Devise - testamentary gift of real property.
  • Devisee - beneficiary of real property under a will.
  • Distribution - succession to personal property.
  • Executor/executrix or personal representative [PR] - person named to administer the estate, generally subject to the supervision of the probate court, in accordance with the testator's wishes in the will. In most cases, the testator will nominate an executor/PR in the will unless that person is unable or unwilling to serve. In some cases a literary executor may be appointed to manage a literary estate.
  • Exordium clause is the first paragraph or sentence in a will and testament, in which the testator identifies himself or herself, states a legal domicile, and revokes any prior wills.
  • Inheritor - a beneficiary in a succession, testate or intestate.
  • Intestate - person who has not created a will, or who does not have a valid will at the time of death.
  • Legacy - testamentary gift of personal property, traditionally of money. Note: historically, a legacy has referred to either a gift of real property or personal property.
  • Legatee - beneficiary of personal property under a will, i.e., a person receiving a legacy.
  • Probate - legal process of settling the estate of a deceased person.
  • Specific legacy (or specific bequest) - a testamentary gift of a precisely identifiable object.
  • Testate - person who dies having created a will before death.
  • Testator - person who executes or signs a will; that is, the person whose will it is. The antiquated English term of Testatrix was used to refer to a female and is still in use in the US.[citation needed]

Drafting a will

There comes a time in everyone's life when they should make a will. A will is a document in which a person owning property makes a declaration of his intentions concerning the distribution of his property when he dies. We usually don't like to consider the thought of dying; thus, we put off making wills. If we would seriously contemplate death, it would do us much good.

Wikipedia defines A will or testament as a legal document by which a person, the testator, expresses his or her wishes as to how his or her property is to be distributed at death, and names one or more persons, the executor, to manage the estate until its final distribution. For the devolution of property not disposed of by will, see inheritance and intestacy.

Though it has at times been thought that a "will" was historically limited to real property while "testament" applies only to dispositions of personal property (thus giving rise to the popular title of the document as "Last Will and Testament"), the historical records show that the terms have been used interchangeably.[1] Thus, the word "will" validly applies to both personal and real property. A will may also create a testamentary trust that is effective only after the death of the testator.

Webster's 1828 Dictionary further defines testament as;

TEST'AMENT, noun [Latin testamentum, from testor, to make a will.]
1. A solemn authentic instrument in writing, by which a person declares his will as to the disposal of his estate and effects after his death. This is otherwise called a will. A testament to be valid, must be made when the testator is of sound mind, and it must be subscribed, witnessed and published in such manner as the law prescribes.
A man in certain cases may make a valid will by words only, and such will is called nuncupative.
2. The name of each general division of the canonical books of the sacred Scriptures; as the Old Testament; the New testament The name is equivalent to covenant, and in our use of it, we apply it to the books which contain the old and new dispensations; that of Moses, and that of Jesus Christ.




1. Generally testator can draft however s/he wants. Public policy exceptions (e.g., cannot marry, no illegal activity, pet gifts). Some conditions ok (e.g., graduate college and age 25).

2. Jesus’ power (Matthew 9:6, John 10:17-18).

3. Conditions on our inheritance (Acts 2:38; Revelation 2:10).

Acts 2:38-39 KJV - 38 Then Peter said unto them, Repent, and be baptized every one of you in the name of Jesus Christ for the remission of sins, and ye shall receive the gift of the Holy Ghost. 39 For the promise is unto you, and to your children, and to all that are afar off, [even] as many as the Lord our God shall call.

1. Only testator can change will; No changes after testator dies. No other gospel (Galatians 1:6-9, 3:15-18).

2. New will invalidates any previous will. New covenant made the old obsolete (Hebrews 8:13).

3. Error – Keeping parts of Law of Moses (Romans 7:4-6); subsequent revelations (Jude 3).

Timeframe

1. Takes effect upon death. Must be death of testator (Hebrews 9:16-17).

2. Inter vivos (takes effect during lifetimes of parties involved; between living persons) gift (Luke 23:39-43).

3. Error – Claiming ineligible inter vivos gift (Luke 23:39-43); Inheritance from another testator (Galatians 1:8-9).

Webster's 1828 Dictionary: EXEC'UTOR, noun The person appointed by a testator to execute his will, or to see it carried into effect.

1. Executor – Carries out will of testator; close out estate. God is the executor (Romans 14:10-12, John 6:38).

Let every man be fully persuaded in his own mind. 6 He that regardeth the day, regardeth [it] unto the Lord; and he that regardeth not the day, to the Lord he doth not regard [it]. Wikipedia: A no-contest clause, also called an in terrorem clause, is a clause in a legal document, such as a contract or a will, that is designed to threaten someone, usually with litigation or criminal prosecution, into acting, refraining from action, or ceasing to act. The phrase is typically used to refer to a clause in a will that threatens to disinherit a beneficiary of the will if that beneficiary challenges the terms of the will in court. Many states[1] in the United States allow for a Will to have a no contest clause, so long as the person challenging the will has probable cause to do so.[2]

2. In terrorem clause or No Contest Clause – Forfeit any inheritance if contested. Cannot contest God’s will (Deuteronomy 4:2, Revelation 22:18-19).

3. Error – Using different executor; Contesting God’s will (John 14:6, 17:17).

Our inheritance?

1. By definition, an inheritance is not earned—it is a gift (Romans 5:15-18, 6:23, Ephesians 2:8). 2. Heaven is the ultimate inheritance (1 Peter 1:3-4) – Imperishable, undefiled, unfading, in heaven. 3. Conditions of the inheritance (Matthew 7:21-24; Revelation 21:7-8) 4. The unrighteous will not inherit (1 Corinthians 6:9-11, Galatians 5:19-21). 5. All have the right to become Children of God (John 1:12-13).

Conclusion
